Terms of Service — PassCut

These Terms of Service ("Terms") are a legal agreement between you and Rosnil Technology Private Limited ("Rosnil", "we", "us"), covering your use of the PassCut mobile application and related pages ("the App"), distributed under our brand ApeLabs. By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Licence
We grant you a personal, worldwide, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own lawful use, subject to these Terms and the app store's terms. The App is licensed, not sold.
2. Eligibility
You must be old enough to form a binding contract in your jurisdiction and able to comply with these Terms. The App is not directed to children.
3. Your content
Photos you process remain yours. The App processes them on your device to produce ID photos, profile pictures, featured images, and cut-outs. You are responsible for having the right to use any photo you import, and for the people depicted in it. We claim no ownership of your content and do not access it.
4. Acceptable use
You agree not to use the App to:
- create fraudulent, forged, or misleading identity or travel documents;
- impersonate another person or misrepresent your identity;
- process images of other people without their consent where required;
- break any law, or any rule of the authority or platform you submit to;
- reverse engineer, resell, or misuse the App except as the law allows.
5. No compliance guarantee; not an authority
PassCut is an independent tool and is not affiliated with, endorsed by, or connected to any passport office, government, embassy, or issuing authority. It targets published passport, visa, and ID photo requirements, which change over time and can be applied differently by different offices. The App is a tool, not a guarantee that any photo will be accepted. You are responsible for confirming current requirements with the relevant official authority before you submit. To the extent permitted by law, Rosnil is not liable for a photo being rejected by any authority or portal.
6. Intellectual property
The App, its design, and its content (excluding your photos) are owned by Rosnil and protected by law. These Terms grant you no rights in our trademarks or branding.
7. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that outputs will meet every requirement.
8. Limitation of liability
To the maximum extent permitted by law, Rosnil and its officers and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the twelve months before the claim (which, for a free app, is zero).
9. Indemnity
You agree to indemnify Rosnil against claims arising from your misuse of the App or your violation of these Terms or any law.
10. Termination
You may stop using the App at any time by uninstalling it. We may suspend or end the licence if you breach these Terms. Sections that by their nature should survive (e.g. disclaimers, liability, indemnity) survive termination.
11. Governing law
These Terms are governed by the laws of India, without regard to conflict of law rules, and the courts at Pune, Maharashtra, India will have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
12. Changes
We may update these Terms; we will revise the date above and, for material changes, provide notice in the App or here. Continued use after a change means you accept the updated Terms.
